Data Processing Agreement

1. Scope

This Data Processing Agreement ("DPA") applies where AI Remote Pros processes personal data on behalf of a client ("Controller") in the course of delivering engineering services. It supplements the Terms of Service and applies to the extent that applicable data protection law requires a DPA.

2. Definitions

"Personal Data", "Controller", "Processor", and "Processing" have the meanings given in applicable data protection legislation, including the GDPR where relevant.

3. Roles

The client acts as Controller of any personal data processed in connection with the project. AI Remote Pros acts as Processor only to the extent that engineers access or process personal data contained within client systems as part of the engagement.

4. Processing Instructions

AI Remote Pros will process personal data only on documented instructions from the Controller, unless required to do so by applicable law. Engineers are instructed to access only the data necessary to complete the agreed scope of work.

5. Sub-processors

AI Remote Pros does not transfer client personal data to sub-processors. Engineers work directly within client-owned systems and do not route personal data through AI Remote Pros infrastructure.

6. Security Measures

AI Remote Pros implements appropriate technical and organisational measures to protect personal data against accidental or unlawful destruction, loss, alteration, or unauthorised disclosure. See our Security page for more detail.

7. Data Breach Notification

In the event of a personal data breach affecting client data, AI Remote Pros will notify the Controller without undue delay and no later than 72 hours after becoming aware of the breach, to the extent practicable.

8. Data Deletion

Upon termination of an engagement, engineers will cease accessing client systems immediately. Any personal data held by AI Remote Pros in connection with the engagement will be deleted or returned upon request.
